Nomacorc has a highly volatile demand for the entire range of its products. To meet this variability, the factory has at its disposal a fixed machinery park and uses existing inventory. However, the demand for generic products only represents 17% of the total sales, which makes it difficult to produce large stocks in advance. Moreover, the production has a four day lead time for any received order. Therefore, the company faces a lack of production capacity. This lack of capacity has been analysed during the project to understand the real causes. The results that emerged demonstrate that some production lines are not used to their full capacity, while others are. The problem of seasonal demand in the production line continues throughout the year. The solution put forward in the project is to increase the machinery park’s flexibility to distribute the workload equally on each production line. Several proposals were given to the company during the project cycle. A program was created to address the impact of these different changes. It appears that Nomacorc could save up to 210.000€ each year by making these changes. We would expect savings to be even higher if all unexpected events are taken into account. Indeed, if a machine fails or a sudden increase in demand appears during the year, the machinery park could be changed to adapt to these unforeseen events while it would not be possible with a less flexible machinery park. By implementing this project, the production will be better prepared for the variability of demand. It will increase productivity while decreasing delays, overtime pay and inventory. By being more flexible, Nomacorc would better react to unexpected events and improve working conditions for employees, as well as returns for stockholders.

La preuve des discriminations s’est développée en droit européen grâce à la jurisprudence de la Cour de justice de l’Union européenne. Afin de comprendre le mécanisme mis en place ainsi que les différents modes de preuve permettant de faciliter la tâche des victimes, il est indispensable, dans un premier temps, d’aborder certaines notions théoriques. La Convention européenne des droits de l’homme et les directives européennes définissent les concepts de discrimination directe et indirecte. Cependant, avant de pouvoir comprendre ces concepts en droit belge, il est nécessaire d’étudier la notion de distinction. Cette étude nous permet de constater que toutes ces définitions sont similaires dans leur contenu mais différentes quant à leur formulation. Dans un deuxième temps, l’examen de l’affaire Jenkins de la Cour de justice de l’Union européenne, qui a introduit le mécanisme du partage de la charge de la preuve, permet de constater qu’un équilibre s’est réalisé entre les preuves que le travailleur-victime et l’employeur doivent rapporter. En droit belge, c’est à travers trois lois du 10 mai 2007, dans un champ d’application élargi, que ce mécanisme fut transposé. Ces législations présentent une liste exemplative d’éléments permettant de présumer l’existence d’une discrimination. Malgré tout, des imperfections sont reprochées à ce système comme celles de l’accès à l’information, de l’emploi de concepts flous et du déséquilibre du procès mais celles-ci ne sont pas dépourvues de solutions. Par ailleurs, différents modes de preuve permettent de s’approcher du but poursuivi. Bien que les modes traditionnels tels que l’aveu, l’écrit et le témoignage soient généralement efficaces, ils sont souvent rares ou nécessitent d’être combinés à d’autres éléments afin de présenter une force probante suffisante. C’est pourquoi, d’autres méthodes plus spécifiques ont été créées, à savoir le test de situation et ses variantes, le mystery shopping, les tests de récurrence et de comparabilité, ainsi que les statistiques. Malheureusement, aucun système n’étant parfait, ces modes de preuve font l’objet de nombreuses critiques dont certains, comme le testing et les statistiques, plus que les autres. Pour répondre aux diverses réticences, des solutions sont envisagées sans toutefois être fréquemment mises en pratique. En outre, les systèmes belge et britannique sont, certes, d’inspiration commune mais le second a une jurisprudence plus développée que la nôtre et applique plus régulièrement les modes de preuves spécifiques contrairement à la Belgique. En conclusion, nous estimons qu’une évolution est à envisager. Un système conforme aux exigences européennes et des modes de preuve spécifiques ont été mis en place en Belgique mais, en mettant en œuvre les différentes voies proposées en réponse aux multiples critiques, en s’inspirant du système britannique et en recherchant d’éventuelles solutions en dehors de la sphère juridique, notre droit se rapprocherait davantage de l’objectif recherché : faciliter à la victime la tâche de prouver la discrimination.

Since April 1st 2016, a new kilometer charge arrived in Belgium for HGV (Heavy Goods Vehicules) of more than 3,5tonnes. This thesis has been written right before the arrival of this kilometer charge was effective. As a consequence, the main goal was to assess the divergent opinions coming from the actors involved in order to determine the expected impact resulting from this new challenge. In this respect, this paper will first provide a quantitative analysis allowing us to answer the hypothsis written in the introduction. This analysis is based on an enquiry (thanks to 17 valid answers obtained). It will then be devoted to a qualitative analysis lead with the help of a family business located in Saint-Georges-Sur-Meuse (Liège, Belgium). Those research will allow us to assess the different impacts endured by the companies involved as well as the disatvantages expected,… These results will be presentend in a swot analysis allowing us to have a clear vision of the different impacts.
